Terms of Service

Effective date: June 9, 2026

These Terms of Service govern your access to and use of SiteClock GPS, including the SiteClock GPS mobile app, website, owner dashboard, admin tools, support channels, and related services. By creating an account, accessing a company workspace, or using the services, you agree to these Terms.

1. Definitions

"SiteClock GPS," "we," "us," and "our" refer to the provider of the SiteClock GPS services. "Customer" means the company, owner, organization, or administrator that creates or controls a SiteClock GPS workspace. "User" means any employee, foreman, administrator, owner, or other person who accesses the services. "Customer Data" means information submitted to or generated through a Customer workspace, including employee records, jobsite information, punch records, GPS punch locations, review notes, and timekeeping data.

2. Eligibility and Authority

You may use SiteClock GPS only if you can form a binding agreement and are legally permitted to use the services. If you create or administer a company workspace, you represent that you have authority to bind the Customer to these Terms and to manage the users and data in that workspace.

3. Accounts and Security

You are responsible for providing accurate account information, maintaining the confidentiality of login credentials, approving or removing users as appropriate, and promptly notifying us of unauthorized access or suspected security issues. You are responsible for activity that occurs under your account or company workspace.

SiteClock GPS may use authentication controls, role permissions, device approval, audit records, and other security features to protect company workspaces. You agree not to bypass or interfere with those controls.

4. The Services

SiteClock GPS provides tools for employee time tracking, GPS-backed punch capture, jobsite management, offline punch sync, payroll review, employee administration, reporting, billing management, and related contractor workforce workflows. Features may vary by plan, device, role, company configuration, region, and release stage.

We may modify, improve, suspend, or discontinue features from time to time. We will make reasonable efforts to avoid unnecessary disruption to active Customers.

5. Customer Responsibilities

Customers are responsible for:

  • Determining whether SiteClock GPS is appropriate for their workplace and payroll needs.
  • Providing required notices and obtaining required consents from employees and users.
  • Complying with employment, labor, payroll, wage-hour, tax, privacy, location tracking, and workplace monitoring laws.
  • Reviewing punch records, corrections, jobsite assignments, weekly totals, exports, and reports for accuracy before using them for payroll or business decisions.
  • Configuring roles, jobsites, geofence settings, device approvals, company settings, and employee records accurately.
  • Maintaining their own payroll, accounting, tax, HR, and employment records as required by law.

6. Employee and User Responsibilities

Users must use SiteClock GPS honestly, lawfully, and only for authorized company purposes. Users may not falsify punch records, spoof locations, use another person's account, tamper with device or location settings to misrepresent work activity, or interfere with the security or integrity of the services.

7. GPS, Location, and Timekeeping Records

SiteClock GPS records location information when users perform punch events or use features that require jobsite location verification. GPS, geocoding, network, device, and map data may be delayed, unavailable, or inaccurate because of weather, buildings, device settings, operating system behavior, weak service, battery state, satellite availability, or other conditions outside our control.

SiteClock GPS provides operational records and review tools, but it does not replace Customer review, payroll approval, legal compliance, or human judgment. Customers are responsible for determining final compensable time, correcting errors, resolving disputes, and complying with all applicable wage and hour laws.

8. Acceptable Use

You agree not to:

  • Use the services for unlawful, harmful, fraudulent, or abusive purposes.
  • Access or attempt to access data, accounts, systems, or networks without authorization.
  • Interfere with, disrupt, reverse engineer, scrape, overload, or probe the services.
  • Upload malicious code or use the services to transmit spam, malware, or harmful content.
  • Misrepresent identity, employment status, location, device status, punch records, or company authority.
  • Use the services in a way that violates another person's rights or applicable law.

9. Customer Data

As between SiteClock GPS and the Customer, the Customer retains ownership of Customer Data. The Customer grants SiteClock GPS a limited license to host, process, transmit, display, secure, back up, analyze, and otherwise use Customer Data as needed to provide, maintain, support, secure, and improve the services and as otherwise described in our Privacy Policy.

Customers are responsible for the accuracy, quality, legality, and permissions associated with Customer Data. We may remove or restrict content if we believe it violates these Terms, law, security requirements, or the rights of others.

10. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect information. By using SiteClock GPS, you agree that information will be handled as described in the Privacy Policy.

11. Third-Party Services

SiteClock GPS may integrate with or rely on third-party services for hosting, authentication, maps, geocoding, analytics, email delivery, payments, app distribution, and other functions. Third-party services may have their own terms and privacy policies. We are not responsible for third-party services that we do not control.

12. Fees, Billing, and Plans

Some SiteClock GPS features or plans may require payment. Paid plan pricing, limits, billing cycles, taxes, and included features are shown at checkout, in the dashboard, or in an order process. Unless otherwise stated, fees are non-refundable except where required by law or expressly agreed in writing.

Customers are responsible for maintaining accurate billing information and paying all applicable charges. We may suspend or limit access for unpaid fees, failed payments, abuse, excessive usage, or violation of these Terms.

13. Beta, Trial, and Free Features

Beta, trial, preview, free, or early-access features may be changed, limited, suspended, or discontinued at any time. These features may be less reliable than generally available paid features and are provided for evaluation or limited use unless otherwise stated.

14. Intellectual Property

SiteClock GPS, including the software, website, app, dashboard, design, logos, text, workflows, and other materials, is owned by SiteClock GPS or its licensors and is protected by intellectual property laws. Except for the limited right to use the services under these Terms, no rights are transferred to you.

Feedback, suggestions, or ideas you provide may be used by us without restriction or compensation, unless otherwise agreed in writing.

15. Suspension and Termination

You may stop using SiteClock GPS at any time. We may suspend or terminate access if we believe you violated these Terms, created risk or liability, failed to pay fees, compromised security, or used the services unlawfully. Upon termination, certain account or workspace access may end, but we may retain information as described in the Privacy Policy or as required for legal, security, audit, backup, billing, or dispute purposes.

16. Disclaimers

SiteClock GPS is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, secure, or that time, location, jobsite, sync, payroll, or report data will always be accurate, complete, or available.

17. Limitation of Liability

To the maximum extent permitted by law, SiteClock GPS will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, payroll errors, employment disputes, business interruption, or cost of substitute services, arising from or related to the services or these Terms.

To the maximum extent permitted by law, our total liability for all claims arising from or related to the services or these Terms will not exceed the amount paid by the Customer to SiteClock GPS for the services during the three months before the event giving rise to the claim, or one hundred dollars if no amounts were paid.

18. Indemnification

To the extent permitted by law, Customers agree to defend, indemnify, and hold harmless SiteClock GPS from claims, damages, liabilities, losses, and expenses arising from Customer Data, workplace use of the services, payroll or employment decisions, violation of law, violation of these Terms, or misuse of the services by Customer users.

19. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date and may provide notice through the website, app, dashboard, or email. Continued use of the services after changes become effective means you accept the updated Terms.

20. Governing Law

These Terms are governed by the laws of the United States and the state where SiteClock GPS is operated, without regard to conflict of law rules, except where applicable law requires otherwise.
